Terms of Service
Effective Date: April 1, 2026
1. Acceptance of Terms
By accessing or using the LactaRoute platform (“Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you are using LactaRoute on behalf of a healthcare practice or organization, you represent that you have authority to bind that entity to these Terms.
LactaRoute is operated by Rooted Maternal Wellness LLC d/b/a LactaRoute, a New Jersey limited liability company.
2. Description of Service
LactaRoute is a practice management platform designed for International Board Certified Lactation Consultants (IBCLCs) and lactation support practices. The Service includes:
- Online scheduling and appointment management
- Clinical documentation (SOAP notes, encounter records)
- Superbill and insurance claim generation
- Client management and care plan delivery
- Third-party integrations (Google Calendar, Spruce, IntakeQ, Office Ally, Stripe, Availity)
- AI-assisted transcription and charting (where enabled)
3. Eligibility and Account Registration
LactaRoute is intended for use by licensed or certified healthcare professionals and their administrative staff. By creating an account, you represent that:
- You are a licensed or certified healthcare provider or authorized staff member.
- All information you provide during registration is accurate and current.
- You will maintain the security of your account credentials and are responsible for all activity under your account.
- You will promptly notify LactaRoute of any unauthorized use of your account.
4. HIPAA Compliance and Protected Health Information
LactaRoute operates as a Business Associate under HIPAA with respect to Protected Health Information (PHI) you upload or generate through the Service. Our Business Associate Agreement (BAA) is incorporated into these Terms and governs our handling of PHI.
You are responsible for: (a) obtaining any required patient authorizations before entering PHI into LactaRoute; (b) using the Service in accordance with HIPAA and all applicable state privacy laws; and (c) ensuring that your use of LactaRoute does not violate any licensing, certification, or professional conduct requirements applicable to you.
5. Subscription and Payment
Access to LactaRoute is provided on a subscription basis. Subscription fees, billing cycles, and plan features are described at the time of purchase and may be updated with 30 days notice.
- Subscriptions renew automatically unless cancelled before the renewal date.
- Fees are non-refundable except as required by applicable law or at LactaRoute's discretion.
- LactaRoute may suspend access for accounts with overdue payments after reasonable notice.
- Payment is processed through Stripe. By subscribing, you also agree to Stripe's terms of service.
6. Acceptable Use
You agree not to:
- Use LactaRoute for any unlawful purpose or in violation of any applicable laws or regulations.
- Upload or transmit content that is false, misleading, or that you do not have the right to share.
- Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service to provide services to third parties (resell, sublicense, or white-label) without written permission from LactaRoute.
- Interfere with or disrupt the integrity or performance of the Service.
7. Intellectual Property
LactaRoute retains all rights, title, and interest in and to the Service, including all software, interfaces, designs, and documentation. These Terms do not grant you any ownership rights in the Service.
You retain ownership of all clinical content, patient data, and other information you enter into LactaRoute (“Your Content”). You grant LactaRoute a limited license to store, process, and display Your Content solely to provide the Service to you.
8. Third-Party Integrations
LactaRoute integrates with third-party services (Google, Stripe, Office Ally, IntakeQ, Spruce, Availity, and others). Your use of those integrations is governed by those providers' own terms and privacy policies. LactaRoute is not responsible for the availability, accuracy, or compliance of third-party services.
9. AI Features
LactaRoute includes AI-assisted features, including audio transcription (via Deepgram, Groq, or OpenAI Whisper, with self-hosted Whisper and AWS Transcribe as fallbacks) and clinical note generation (via Anthropic's Claude). These features:
- Are intended to assist — not replace — your clinical judgment. You remain solely responsible for the accuracy and completeness of all clinical documentation.
- May produce inaccurate or incomplete output. You are responsible for reviewing and correcting all AI-generated content before it becomes part of a patient record.
- Send audio to the transcription services named above and note text to Anthropic. Audio recordings are processed in real time and are not retained by LactaRoute after transcription is complete.
- Are available only on applicable paid plans. LactaRoute may modify, suspend, or discontinue AI features at any time with reasonable notice.
10. Text Messages
This section covers the text messages sent through LactaRoute. It applies to anyone who agrees to receive them, including families who book with a practice that uses LactaRoute.
- Who sends them. Texts come from the practice you booked with. They are sent through LactaRoute, the software the practice uses.
- What they are. Appointment confirmations and reminders, updates about your care, links to intake forms and payments, and replies to messages you send the practice. No marketing texts are sent.
- How you agree. A family is texted only after agreeing to it — for example, by ticking the optional text-message box on the practice's booking page. Agreeing is not a condition of booking, of care, or of any purchase.
- How often. Message frequency varies with your appointments.
- Cost. Message and data rates may apply.
- Stopping. Reply STOP at any time to stop receiving texts. Reply START to receive them again.
- Help. Reply HELP for help, or contact the practice directly.
- Delivery. Mobile carriers are not liable for delayed or undelivered messages.
- Your number. Mobile numbers and text-message opt-in data are never sold, and never shared with third parties or affiliates for marketing or promotional purposes. They are shared with our messaging carrier only to deliver the texts you agreed to. See our Privacy Policy.

11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LACTAROUTE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
LACTAROUTE IS A PRACTICE MANAGEMENT TOOL. IT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT RECOMMENDATIONS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LACTAROUTE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO LACTAROUTE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. LACTAROUTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
13. Indemnification
You agree to indemnify, defend, and hold harmless Rooted Maternal Wellness LLC d/b/a LactaRoute, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any PHI you submit to the Service.
14. Termination
Either party may terminate the subscription at any time. Upon termination, your right to use the paid Service ceases. For 60 days after termination you may still sign in to export your data (Settings → Plan and account → Everything, as one file). Within 60 days of termination LactaRoute returns or destroys all PHI as the Business Associate Agreement sets out; where that is not feasible, the BAA's protections continue to apply to whatever is retained.
LactaRoute may suspend or terminate your account immediately for violations of these Terms, non-payment, or as required by law.
15. Modifications to Terms
LactaRoute may update these Terms at any time. We will provide at least 30 days notice of material changes via email or in-app notification. Continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of New Jersey. Any dispute arising from these Terms shall be resolved by binding arbitration in New Jersey, except that either party may seek injunctive relief in any court of competent jurisdiction for intellectual property or data security matters. For users located outside the United States, arbitration may be conducted remotely via videoconference, and the arbitrator shall consider the user's jurisdiction when determining procedural matters. Nothing in this section limits any rights that users in the European Economic Area, United Kingdom, or Canada may have under mandatory consumer protection laws of their jurisdiction.
